While SCOTUS ruminates Burwell, while the governors await word of the fates of their budgets based on how SCOTUS holds, and while Left and Right harangue one another over subsidies, death spirals, what someone meant, who can and can’t afford what, and while we all argue over what was left on the edit floor by those who wrote this damned law, it seems everyone is missing the only salient point of Burwell.
Either Americans still live under the Rule of Law – or we do not.

“What’s the solution to this mess? … getting rid of mandates, allowing people to choose their own insurance benefits and offering universal tax credits to everyone is a start, as well as making health savings accounts more accessible. All of the provisions in ObamaCare that encourage employers not to hire people or to reduce their workers’ hours should go, as should the provisions that prevent employers from providing their employees with insurance that would travel with them from job to job.”
1. Against ALL conventions of Application Development, neither System nor User Requirements EVER were fixed. In the app development world this means Obamacare NEVER had a set of Requirements that could be architected, designed, coded or tested. AND THE DEVELOPERS KNEW THIS; IT’S WHAT THEY DO. It is not ‘the website did not work,’ it is ‘the website COULD not work.’ That is a non-trivial difference that cost the taxpayers – so far – over $600M.
